terms of service

These terms are the agreement between you and YES! Inc. ("we", "us") for using yes.land, the photo booth, the PalPass, our letters and texts, and meeting GoodGood in person (together, the "Services"). By using the Services, you agree to these terms and to our privacy policy.
1. who can use the Services
Anyone can visit the site and play in the photo booth. Kids are welcome, and we'd love for them to play with a grown-up.
To make a PalPass you must be 18 or older and a parent or legal guardian of the children in your family. When you tick the box on the PalPass form, you are telling us that's true, and you are agreeing to these terms for your family.
2. what the PalPass is
The PalPass is a free pass that carries the outfits your family picked for GoodGood. It's how we get to know your family, how we let you know when GoodGood is near, and what you show or tap when you meet him.
The PalPass is not:
- a purchase, a ticket you paid for, or an order for any product;
- a promise that GoodGood will visit your town, or that you will get to meet him;
- a reservation or a place in line for anything.
Where GoodGood goes, and when, is up to us. Meets may be changed or cancelled, including for weather, safety, or GoodGood needing a rest.
One PalPass per family, please. A pass holds up to four GoodGood outfits, so there's room for everyone's. Your pass is personal to your family: please don't share your sign-in links or your three-word code with people outside your family.
You can edit your pass at any time, and delete it whenever you like (see the privacy policy). We may change, pause, or end the PalPass at any time, and we may remove a pass that breaks these terms.
3. using the Services fairly
We encourage all families to have fun and play together with the photo booth. We also ask that you:
- use a family name, not someone else's name or anything rude, hateful, or misleading;
- keep the note to GoodGood kind, and leave out private details like addresses, phone numbers, or health information;
- not try to get into another family's PalPass, or guess or collect other families' three-word codes;
- not try to break, overload, copy, or scrape the site, the booth, or the pictures it makes;
- not use the Services for anything illegal, or to harass, threaten, or hurt anyone.
We may change or remove a family name, a note, or a pass that breaks these rules.
4. your outfits and their pictures
The pictures the booth makes of your outfits are yours to keep. Save them, put them on the fridge, send them to grandma, or post them on your own social media, for personal, non-commercial use. GoodGood himself, his look, and the booth's art still belong to us and the people who license them to us (see section 7).
You give us permission to store your designs and pictures, to show them to you on your pass, to show them to our staff at meets so GoodGood can recognize your family, and to show your own small picture on your pin in a browser that's signed in to your pass. Other visitors only ever see our own drawing of GoodGood in the pose you picked. We won't use your family's pictures in ads, or show your family name publicly, without asking you first. This permission ends when you delete your PalPass.
5. meeting GoodGood
Please follow the safety rules and our staff's directions whenever you meet GoodGood.
A grown-up stays with the kids. Children must be with a parent, guardian, or another responsible grown-up at all times at a meet, and that grown-up is responsible for their care and safety the whole time.
GoodGood moves. He's an animatronic: a robot with motors and moving joints. Keep the space around him clear, and only touch him when our staff invite you to.
Taking part is your choice. Meeting GoodGood is voluntary, and your family takes part at its own risk. To the fullest extent the law allows, you release YES! Inc. and its team from any claims for injury, loss, or damage that come from your family taking part in a meet, except where caused by our gross negligence or intentional misconduct. You agree to this for yourself and, where the law allows, for the children in your care.
Photos and video. Meets may be filmed and photographed by our team, and the people around you may take their own pictures too. We may share what our team films, for example in the clips on our website and on social media. If you'd rather you or your child stayed off camera, or want a face blurred, tell our staff at the meet. If you spot yourself or your child in something we've shared and want it taken down or blurred, email hello@yes.land, and we'll do our best to remove or blur it on our own website and accounts.
Stamps. When you meet GoodGood, our staff may add a stamp to your pass with where and when you met, and sometimes a short note.
6. emails and texts
By making a PalPass you agree to get emails about your pass and letters from DeeDee. You can stop the letters at any time with the unsubscribe link.
Texts are sent only if you add a US phone number and tick "text me when GoodGood is near". We don't send texts yet. When we start, you'll get a few texts a year, when GoodGood is visiting somewhere near you. Message and data rates may apply. Reply STOP to stop them at any time, or HELP for help. Agreeing to texts isn't required to get a PalPass. Mobile carriers aren't responsible for texts that arrive late or not at all.
7. our content
yes.land, the photo booth and its frames, and the site's design, art, animation, sounds, and code belong to YES! Inc. or the people who license them to us. GoodGood and the World of With Love are owned by With Love Labs (Internet of Heart, LLC) and used by YES! Inc. under license. Except for the personal use in section 4, please don't copy, sell, or reuse any of it without our written permission. To ask about using our logos or characters, email hello@yes.land.
The town search uses place data from GeoNames, licensed under CC BY 4.0.
8. the usual limits
The Services are provided "as is" and "as available". We work hard to keep them running and safe, but we can't promise they will always be available or error-free, or that a pass or picture will never be lost, and we make no other promises about them, including implied ones.
To the fullest extent the law allows, YES! Inc. and its team are not liable for indirect, incidental, or consequential damages, or for damages caused by things outside our reasonable control, arising from your use of the Services, and our total liability for any claim about the Services is limited to $100. These limits don't cover anything the law doesn't allow us to limit, including harm caused by our gross negligence or intentional misconduct.
9. stopping
You can stop using the Services whenever you like: unsubscribe from letters, reply STOP to texts, and delete your PalPass on your PalPass page. We may suspend or end anyone's use of the Services, or remove a pass, if they break these terms or put others at risk. The parts of these terms about risk, limits and disputes (sections 5, 8 and 11) still apply afterwards.
10. changes to these terms
We may update these terms. We'll post the new version here with a new date, and email PalPass families about important changes before they take effect. If you keep using the Services after that, the new terms apply.
11. law and disputes
YES! Inc. is a Delaware corporation based in Detroit, Michigan. These terms are governed by the laws of the State of Michigan, without regard to its conflict-of-law rules. If something goes wrong, please write to us first at hello@yes.land, and we'll try to sort it out together. Any dispute about these terms or the Services that we can't settle that way will be heard only in the state or federal courts located in Wayne County, Michigan, and you and we agree to those courts' jurisdiction.
12. the rest
If any part of these terms can't be enforced, the rest still applies. If we don't enforce a part of these terms right away, we can still enforce it later. These terms and our privacy policy are the whole agreement between you and us about the Services. If YES! Inc. is ever merged or sold, these terms move with it.
